About the Accruing | Advance Leave

Advance leave is chargeable leave granted in anticipation of the accrual of leave during the remaining period of active duty and may be granted for:
  • -A soldier who has an emergency
  • -A soldier who has an urgent personal or morale problem.
  • -Accession or PCS move.
  • -A pregnant soldier who desires home leave.
    Advance leave is with pay and allowances, including leave accrual. Soldiers may be granted advance leave only when accrued leave is exhausted, advanced leave changes to excess leave on date of separation, reenlistment, or entry into an extension of enlistment.

    Advance leave may be granted together with expiration of term of service (ETS) or retirement provided transition processing is not interfered with.

    • Under what circumstances are Merit employees eligible for military leave?
      Merit employees who enter active military service are entitled to a leave of absence for the period of time of their tour of duty, extended for 90 calendar days beyond the date on which their active duty terminates. In addition, Merit employees who are members of the National Guard or Reserves who are ordered to attend training or special duty training during scheduled work hours are entitled to paid military leave of 112.5 hours (based on a 36.5-hour workweek) or 120 hours (based on a 40-hour workweek).     • What happens when I exhaust paid military leave?
      Employees may take unpaid leave of absence or request to use accrued annual leave. Holiday pay, annual leave, and sick leave do not accrue during leaves without pay greater than 30 days.
    • Are employees entitled to both their military and State of Delaware (State) salary during periods of military leave?
      Employees called to active military service for any operational mission to augment active forces as ordered are eligible for a continuation of their State salary, less any military compensation received. The amount of salary continuation will include the amount of employees’ salary funded by State appropriation, Special Funds, or Federal funds. State compensation is limited to base salary only and does not include hazardous duty pay, shift differential or any other special pays.
    • What happens to my benefits while I am on active duty military leave?
      Employees may continue all their State benefits while on active duty military leave. For their group health benefits, the State share of medical benefits will continue for the first two years of active duty military absence as long as the employee submits a monthly payment for their employee share of the cost of elected coverage. All payments should be made payable to the State of Delaware and forwarded to the employee’s agency Human Resources Office for processing.
